Understanding weapons & firearms charges

Weapons and firearms offences — unauthorized possession, possession for a dangerous purpose, careless storage, and offences involving prohibited or restricted weapons — are treated severely by Canadian courts, and convictions commonly carry weapons prohibition orders on top of any other penalty.

Many of these cases begin with a search: of a vehicle, a home, or a person. How that search happened is often the heart of the defence, alongside what the Crown can actually prove about knowledge, control, and the legal character of the item itself.

How We Defend

  • Challenge the search and seizure that produced the weapon

  • Contest knowledge and control — presence is not possession

  • Examine the classification of the item and the licensing framework

  • Scrutinize continuity and handling of the physical evidence

  • Address prohibition orders and their scope where conviction risk exists

Every case turns on its own facts. Call 519-977-5407 for a confidential assessment of yours.

Common Questions

Weapons & Firearms: what people ask us

The gun wasn't mine — I didn't even know it was there.

The Crown must prove you knew about the weapon and had control of it. In shared cars and homes that is often genuinely contestable, and it is a frequent battleground in these prosecutions.

Do replica or airsoft guns count?

They can — imitation firearms used in offences, and some replicas themselves, are captured by the Criminal Code. The classification questions are technical and worth a proper legal review.
